Les compétences du conseil municipal
Les compétences du conseil municipal sont définies par l’article L. 2121-29 du Code général des collectivités territoriales (CGCT) qui dispose que « le conseil municipal règle par ses délibérations les affaires de la commune ». Cette disposition consacre la clause générale de compétence communale, complétée par des attributions spécifiques expressément prévues par la loi.
I- Désignation des organes de direction communale
- Élection du maire et des adjoints
Conformément aux articles L. 2122-1 et suivants du CGCT, le conseil municipal, réuni dans les trois jours suivant le scrutin électoral (art. L. 2121-12 CGCT), procède à l’élection du maire au scrutin secret, à la majorité absolue des suffrages exprimés des conseillers en exercice.
En cas d’égalité, le scrutin est renouvelé et, à défaut, celui ayant obtenu le plus de voix est élu. Les adjoints sont élus selon les mêmes modalités dans la limite du tiers de l’effectif du conseil (art. L. 2123-13 CGCT).
- Représentation intercommunale
L’article L. 2121-29, 9° CGCT confère au conseil municipal compétence pour désigner ses délégués auprès des EPCI (établissements publics de coopération intercommunale), syndicats mixtes et autres organismes intercommunaux.
II- Compétences budgétaires et fiscales
- Approbation du budget et des comptes
L’article L. 2312-1 CGCT réserve exclusivement au conseil municipal :
- Le vote du budget primitif avant le 15 avril ;
- L’adoption du compte administratif ;
- La décision relative aux emprunts et affectations de crédits.
Ces décisions requièrent la majorité absolue des membres présents.
- Fiscalité locale
Le conseil fixe les taux des taxes directes locales (art. L. 2321-1 et suivants CGCT) et délibère sur la création ou suppression de taxes facultatives.
III. Urbanisme et aménagement du territoire
- Documents d’urbanisme
Le conseil municipal est compétent pour approuver (art. L. 153-20 CGCT) :
- Le Plan Local d’Urbanisme (PLU) ;
- La carte communale ;
- Les Orientations d’Aménagement et de Programmation (OAP).
- Servitudes d’utilité publique Conformément à l’article L. 421-1 du Code de l’urbanisme, le conseil peut instituer des servitudes d’utilité publique après enquête publique.
- Opérations d’aménagement
Compétence pour créer des zones d’aménagement concerté (ZAC) et délibérer sur les acquisitions ou aliénations de biens immobiliers.
IV – Organisation des services publics communaux
- Réglementation des services publics
Le conseil municipal adopte les règlements des services publics administratifs (écoles, crèches, bibliothèques) et règle les tarifs des services publics industriels et commerciaux. - Subventions et participation
L’article L. 2252-2 CGCT autorise le conseil à allouer des subventions aux associations poursuivant un but d’intérêt général.
V- Contrôle juridictionnel des délibérations
- Recours pour excès de pouvoir
Toute personne ayant un intérêt suffisant peut saisir le tribunal administratif dans un délai de deux mois à compter de la publicité de la délibération (art. R. 421-1 CJA). Le Conseil d’État a précisé que l’intérêt à agir s’apprécie au cas par cas (CE, 12 mai 1993, Mme A.). - Contrôle de légalité
Le préfet exerce un contrôle a priori et peut demander la suspension d’une délibération illégale ou la former devant le juge administratif (art. L. 2132-1 CGCT). - Publicité des délibérations
Les délibérations doivent être affichées pendant huit jours francs à la porte de la mairie et transmises au préfet dans les deux jours (art. L. 2121-27 et L. 2121-35 CGCT).
